SEVIERVILLE — A Sevier County Grand Jury returned an indictment this week against a local man charged with killing his girlfriend in what he told a 911 dispatcher was an accident.

Jacob Stanton, 21, is charged with second-degree murder in the Nov. 17 shooting death of 18-year-old Leah Avril.

A recording of Stanton’s call after the shooting shows he told the dispatcher the shooting was an accident. “I didn’t think the gun was loaded and I was putting it away and it accidentally went off,” he told the dispatcher.

The indictment is the last hurdle the case had to face before trial, although defense attorney Joe Baker could file motions that a judge would have to consider before the trial could begin.

Also this week, the grand jury returned an indictment against a Sevierville man who allegedly was responsible for a fatal motorcycle accident.

Larry C. McGlaughn is charged with vehicular homicide, reckless vehicular homicide, possession of drug paraphernalia, driving on a canceled license, DUI and felony evading arrest.

Officers say McGlaughn was driving a motorcycle on Upper Middle Creek Road when he lost control of the bike and it hit a county highway sign and an embankment. His passenger, Brian Renfroe, died at the scene.

The grand jury is a panel of 12 randomly selected county residents who meet in private to review criminal allegations to determine whether there is enough evidence to justify proceeding with a trial. They do not determine guilt or innocence.

A new grand jury is selected every two months and meets at that time to review allegations.

If a grand jury determines there is not enough evidence to merit a trial, it can return a finding on “no true bill.” If they find there is enough evidence to proceed, they can return an indictment or a presentment.

Indictments are returned in cases where the charges against the accused party have already been announced in general sessions court, and a judge has sent the matter to the grand jury. Presentments are returned when the grand jury issues charges that had not been announced previously. Sealed presentments are kept secret until the defendants are arrested.

Names that are listed more than once represent people who faced multiple indictments.

"Redundant Criminal" that has a nice ring to it. It also describes half the population of Sevier County and seems to rival "STUCK ON STUPID".

Then we see "DUM DUM" and the moving gun. Self descriptive indeed! I would take a wild guess he shot himself in the foot a long time ago.

That woman in central Tennessee shotgunned her preacher husband in the back as he slept and got a whole 36 days in prison. Now she's suing the dead man's parents (her in-laws) over seeing her children. Watch the double standard in these domestic cases. Most cops will not write up a guy's complaint against his wife.
