  • Ex-supervisor at jail pleads to sex charge; Lintner faces 1-2 years for illegal content with inmate

    SEVIERVILLE — A former kitchen supervisor at the Sevier County Jail pleaded guilty Tuesday to a single count of having sexual contact with an inmate.

    Paul Lintner faces one to two years in jail and a fine of up to $3,000 for the felony charge. His sentence was not set in the plea agreement; Circuit Judge Richard Vance will determine that at a Dec. 8 hearing.

    With the guilty plea, the state dropped five additional charges against Lintner.

    District Attorney General Jimmy Dunn said the state wants Lintner to serve time in jail.

    The attorney representing the former inmate that Lintner victimized said they were satisfied with the plea. “We are happy with the guilty plea, and it reflects what our investigation showed,” Dana Pemberton said. “We appreciate the efforts of the district attorney’s office and particularly Assistant District Attorney Steve Hawkins.”

    The Mountain Press generally does not identify victims of sex crimes. The victim in this case has filed a federal complaint against the county seeking $15 million in damages. A second inmate has filed a complaint claiming Lintner harassed him, but did not have intercourse with him.

    While Lintner announced he was pleading guilty, his defense attorney, Charles Sexton, indicated Lintner was taking the plea because it was in Lintner’s best interest.

    Neither Linter nor Sexton answered questions as they left the courthouse. Lintner remains free on bond pending sentencing.

    As Hawkins outlined the state’s case against Lintner, he indicated Lintner was exchanging favors for trusties for sex.

    “Mr. Lintner was over the kitchen and also had under his command several trusties who lived separately and worked under his supervision,” Hawkins told Vance.

    He once took the victim to Food City to visit the inmate’s mother, who worked there, and also took the victim to visit his family on Christmas while he was incarcerated. The victim’s family took pictures that day with Lintner visible in the photographs, Hawkins said. Lintner also paid the victim’s mother about $2,500 while the man was in jail.

    Lintner continued trying to call the victim after the man was released, although the man wanted no further contact with Lintner, Hawkins said.

    Hawkins also said that another former inmate would have testified to having seen Lintner and the victim having sex.

    Lintner became kitchen supervisor after serving time at the jail for forgery.

    According to documents from the state court of appeals, he had also been convicted of tax evasion, but was actually believed to have taken almost $800,000 from a previous employer.

    “Appellant was apparently never punished directly for his embezzlement of $785,731 from his previous employer, rather he was convicted of federal tax evasion in connection with the embezzled funds,” Appellate Judge Jerry Smith wrote.

    Lintner was sentenced to 21 months in prison for that conviction, and then placed on probation.

    “While on federal probation he committed the instant (forgery) offenses using forgery to steal from his subsequent employer,” Smith wrote. “It is clear that measures less restrictive than continuous confinement have not made an impact on appellant.”

    The court was actually ruling on an appeal by Lintner for alternative sentencing on the forgery conviction. It ruled he should complete his sentence.

    Lintner served his time for that forgery conviction in the Sevier County Jail. Upon his release, he was hired as the jail’s kitchen supervisor, where he was placed in charge of county funds and of trusties.

    He was hired during the tenure of the late Sheriff Bruce Montgomery.

    Current Sheriff Ron Seals declined to comment on the specifics of the case. He did say it would have been a violation of the rules for Lintner to take an trusty for a visit with family.

    “It would be out of the realm to go to the mom’s house,” he said.

    Former sheriff’s deputy and sheriff candidate Kim Pierce has been outspoken about Lintner’s hiring and behavior.

    “I feel very vindicated,” she said Tuesday. “There were a lot of people who were passing me off as crazy.”

    She said she preferred to see Lintner convicted on all counts against him.

    “Ultimately I guess I’m disappointed with only one count,” she said. “I am happy that he owned up to what he’d done.”

    She credited the victim for coming forward when many men in similar situations wouldn’t.

    “There’s a lot of men who wouldn’t do what (he) did,” Pierce said.

    Judge Vance sentenced Paul Lintner to two years in prison today he is to report on Jan 2, 2010 Seals model employee may have more fun playing with the big boys in Nashville. I sure hope no one accidentally has sex with sex.

    I sure hope Paul Lintner gets some time his sentencing date is set for Dec 8, will the system punish him or will he get probation. I wonder how much the 2 federal lawsuits will cost the taxpayers of Sevier County since he plead guilty to having sex with a male inmate in the jail. Montgomery and Seals were crazy for hiring a convicted felon to over all the young male trustee's and then allowing him to be over the food purchasing for the jail how dumb can you be.

    Someone now needs to look into all the food purchases from the Newport Bargain Mart and all those hand written reciepts and see where all that food was going, anyone who was in jail or juvie during that time can tell you they were not getting it. They were starving while our tax dollars bought steak, shrimp, fish, hamburgers, and many other items that never ever went thru the doors of the jail.. This investigation should not be over is it really...

    I just happen to think that this has nothing to do with a campaign!!!!!! Do you people who comment against Pierce not realize what has happened is completely wrong!!! The guys in charge of the Sheriff's Department need to be removed and I dont care who it is that takes their place. I hope I never have to deal with this county and "their legal system" cause it is not right. Paul Litner is a sexual predator and a crook who can deny that? What she did is see something extremely wrong, if it would have been anyone else would this mudsling still be going on?

    It is abundantly clear that the 2010 Campaign for Sevier County Sheriff has begun. As with the past, we see that the opposition candidates have no positive platform to present so they will mud sling and slander their way into contention once again.

    As with the past, we will see once again, that the voters of Sevier County are just too astute to fall for this cheap political trick and preposterous posturing.

    I have watched this Sevier County Circus unfold for years. When Lintner was first turned in 3 and a half years ago, I wondered how long it would actually take for him to pay for his latest escapades. Having been a former employee of the Sevier County Sheriffs Department, I witnessed first hand the power that this convicted felon had on the "powers that be" in the sheriffs office. He was allowed to take inmates anywhere he wanted to. He took them to the grocery store, the hardware store, the bargain barn in newport. These inmates left the jail uncuffed and unshackled and were gone for hours at a time--no questions asked. I know of several officers who took prisoners just across the parking lot to the court house unshackled and lost their jobs!! Yet, a convicted felon, non certified, civilian was allowed to go anywhere and apparently do "anything" he wanted to with him. If anyone thinks that his having sex ONE time in jail with an inmate was an isolated incident, PLEASE wake up from the fog and look at reality!! Also if anyone wants to dispute the fact that these inmates left in his care, the jail log books that are kept of all the people who enter and leave the building will show all of the trips he made in and out with these boys...for years...and years..this man was given a buffet of exactly what he wanted, young, vulnerable boys. And, please don't think that he was given these "tasty treats" for nothing. The "powers that be" in the SO made use of Mr. Lintners accounting/mathmatical/ability to move funds...talent as well. As several in the rat race have pointed out (to no avail) their are thousands and thousands and thousands of dollars worth of unexplained monies that have been acquired or lost or pocketed by many in power --thanks to Mr. Lintner and all of his handwritten reciepts. It truly comes in "handy" when you employ an experienced embezzler. So, in conclusion, it's a whole lot easier to ignore the facts and try to tarnish the ones that actually are trying to do right, then it is to use common sense and see the truth. Carry on Kim!!! Their are many many people that are behind you--just be thankful you aren't a male inmate or that could have a whole new meaning!!!

    If you can not see the justice that was finally enforced because a CITIZEN stood up and fought for justice, maybe you should find another career. Apparently all you will ever be is an ambulance chaser.

    Becoming a lawyer is protecting the law and protecting those who have been hurt by those not following the law. You will never understand that. You sound like someone who is only becoming a lawyer because you see the big bucks or following in daddy's footsteps.

    Find another career and stop bad mouthing those who are standing up for those who can not stand for themselves!

    Ms. Pierce's lack of ability to be paramagnetic and objective born out her termination has fermented into disdain and vengeance.

    As I recall, she is the daughter of Carmen Townsend's girlfriend and only attained the position as a deputy by appointment through the same corruption channels she castigates today.

    The voters have spoken many times and she is not qualified to hold the office. The further she is removed from law enforcement, the better off the citizens of this county will be. That is not only my judgment, it seems to be the overwhelming judgment of the moral majority of voters as well.

    This thorn needs to find a new rose to irritate.

    I say Kim is the bigger person in all this,She saw the wrong an she too could have walked away to let a sick man like this cont.to rape an abuse the inmates but she instead took a stand for the right,could all you people downing maybe feel guilty that you don't have a heart or are to scared to stand up an fight for whats right,I am proud that we have someone like her to fight for the rest of us,Instead of bad mouthing her we should all stand up and say THANK _YOU KIM for still standing up an fighting for our Town!!!!!!!

    I know from working for the county that Kim Pierce is not crazy. There are alot of crimes hidden and lied about by our officials. Just work for the Court for a month and you would see some unbelieveable activities. Kim thank you and I hope you bring down the officials that seem to think they can keep taking advantage of the citizens of sevier county.

    It clearly demonstrates why she has the title of FORMER in her attempts at a law enforcement career.

    Why was this man ever hired in the first place to be in the position he was in? This makes me sick. The guys that were in jail during his time just had more trouble added to their already crazy lives. He is a criminal and now a sexual predator. I dont know Kim Pierce but I would say whether she is running for sheriff or not she was doing the right thing and not sweeping it under the rug, like most people around here do!

    i have heard of this man for years -how did he get away with all of this ,he embezzeled 785,731 then was hired and put in charge of county money ,he is gay and put in charge of inmates so he could use his authority to get sex favors-it looks like he is still being protected-no wonder alot of people have no respect for the law

    To counter point have you forget I took this very same matter to Sheriff Mongomery and Mayor Larry Waters and the full County commission to get him out of the jail over and over again, and then I tried to go before the grand jury to get the District Atty to do something,and they would not allow my witness which ny the way was the same witness that got the conviction, it was even brought to Seals attention he called Lintner a model employee on the local radio station and said he knew of nothing Lintner had done wrong that is not true, inmates had already written many letters of complaints prior to all of this, Seals knew what Lintner was doing all along, but it was only after the F.B.I. investigated that Lintner was finally removed from his job at the jail, at the time I did not know there were other people who worked at the jail who had already came forward before me about Paul Lintner , It all got started over Mark Weber a boy who died while an inmate in jail that was rumored to be one of Paul's boys, thats what got all this started, this is not about being elected Sheriff, but if that gives me a platform to stand up and make change so be it, this is more about holding people accountable and doing whats right, Paul Lintner should have never been hired in the first place. And to give him control of all purchasing was just plain dumb, and to put him over all the the young male inmates when he is more of a criminal than the ones he is watching, something is bad wrong. Had myself an others and you know who you are,, if we had not took a stand he would still be there today maybe victimizing your son or someone eles's, trust me they would not have fired him, I know in my heart I did the right thing you can think what you want about me. Its not always about winning you guys just don't get that do you.. I am winning. Even if I am never Sheriff. God puts us right where he want us. Maybe I'm just supposed to be a thorn.
