Sevierville Planning Commission approves rezoning
Despite a complaint from a concerned neighbor, the city's Planning Commission recommended approval for the rezoning of 1401 Old Newport Highway from R-1 (residential) to C-3 (residential and light commercial) at its meeting Thursday evening. The meeting took place at the Civic Center.
The single-family-home property in question sits in an R-1 residential section between Old Newport Highway and Dolly Parton Parkway. Across Cherokee Circle to the west is a C-4 district, which includes Tennessee Hot Tubs and La Carreta Mexican restaurant.
Stanley Creswell, the concerned neighbor who has lived across the street from the property for 35 years, said the property owner, Mark Galli, wanted to put a laundromat at the location.
"He came and talked to me and ... I told him I didn't like that idea," Cresswell said. "I told him I don't have a problem with it being commercial, but where it's located, I don't think it would be advantageous to me to have a 24-hour business across the street."
Cresswell recited a city ordinance that stated regulations are designed to maintain the character of the community.
"And I don't think a 24-hour business would maintain the characteristics of the community," he said.
Planning Commissioner Teddy Murrell recalled a similar situation from years ago, in which the Planning Commission approved rezoning, but the Board of Mayor and Aldermen later denied it. The requester then sued the city and won, Murrell said.
"They did qualify," Murrell said. "I don't think there's anything we can do about it."
After hearing these comments, the commission reluctantly approved the rezoning.
"Given that other properties in this intersection are commercially zoned, staff can recommend approval," Interim Director Judi Forkner said.
The item will be presented for consideration at the next Board of Mayor and Aldermen meeting, June 17.
The Planning Commission met Thursday at 5:30 p.m. in the Civic Center. It also approved:
n A request to rezone 2270 Two Rivers Boulevard from C-3 to C-4
n A request to rezone property at 421 Park Road from R-2 to C-3
n Annexation of property in Hidden Mountain Estates Phase 8 (Tax Map 71L, Group D, Parcels 142, 143 & 144) as requested by SFG Capital Partners
n Placement of V-1 zoning on the annexation request in Hidden Mountain Estates as requested by SFG Capital Partners
n A 9.25-square-foot electrically activated message center to be added onto Fort Sanders Sevier Senior Center's existing 120 square foot monument ground sign
